pets rights in a fenced yard

My 10 month old has bitten 2 kids already. He has always play bit with us and our kids we could never get him to stop, anyway ac almost tried to make us put him down, then they wanted us to give him up and they would adopt him out to a new family. I said to take me to court and I would fight it so they dropped it. My question is I had to fence in my backyard to keep him I want to know if a kid comes up and gets bit through the fence can they make me put him down.
