Question:

: I am the owner of a 6-month-old male JRT that has just been diagnosed with Legg-Perthes disease. My vet recommends surgery. I am wondering if the breeder is responsible to reimburse me for this procedure, or for a full or partial refund of the price of the dog. In addition, to the expense of surgery/follow-up care, I will be unable to breed him. Your comments please.

Dear Mary Katherine,

In general, if you don't have a signed contract that specifically addresses reimbursement for a genetic problem and/or a refund if the pup is not "breed" quality then your breeder is not "monetarily" responsible. I've heard that some states have "lemon laws" that apply to pets; if you want to pursue this idea, I suggest you contact your local animal shelter.

That said, I would hope that your breeder is willing to discuss the situation with you. In my opinion -- and this is just MY opinion -- a fair compromise would be a refund of the difference between a "pet" quality puppy and a show/breed quality puppy.
